Thank you for your online purchase with Your order will be carefully packaged on our custom fabricated shipping skids to provide maximum protection to your product while in transit. All our products are new and come with their original manufacturers packaging and warranty. We do not sell seconds or damaged products. Most orders are delivered by LTL truck via curbside delivery. Very small orders that are deemed safe to ship via common carrier will be shipped via UPS or FedEx Ground. Shipping charges will appear during your checkout process. Shipping charges generated by the automated system are estimated. Please call to confirm shipping charges if you feel the system's estimate appears inconsistent with the order and we will gladly offer you a manual quote. Please note orders consisting of product that is sourced from multiple suppliers will likely incur additional shipping charges. Customer service will contact the Buyer whenever this occurs so there will not be any surprises.Only professional delivery companies are entrusted with delivering product to Magic Floors customers. Delivery area is within the contiguous United States. Please note that professional delivery companies do assess extra fees in relation to certain deliveries therefore it is very important to comply with their policies in order to avoid inadvertent fees. Examples of such fees include:

  • - Refusal of shipment (Shipment should not be refused under any circumstance since the act of refusal always results in additional fees regardless of the circumstance. Please note all the issues on the BOL paperwork, accept the shipment and contact Customer service ASAP)
  • - Shipment to a limited access area (including but not limited to metropolitan area, or where only a small box truck is able to make it to the designated address.)
  • - Change of address after material has shipped
  • - Buyer is unwilling to receive shipment within the allotted 2-5 business days depending on carrier
  • - Shipment not picked up from a terminal within allotted 2-5 business days depending on carrier

Please, provide us with a phone number at which you can be reached 24/7. The trucking company will call you prior to residential delivery to schedule the delivery. Please specify a valid street address for delivery. No deliveries can be made to a P.O. Box. Your shipment will be insured. Prior to shipment, the warehouse manager will check all materials to make sure that nothing is damaged. The material will be securely attached to a pallet. An average sale requires 7-10 business days from start to finish as long as the product is available in the U.S.A. Please keep in mind that items imported from overseas require 6-12 weeks lead time from factory to the supplier's warehouse. We recommend that you make your purchase without delay as soon as you confirm your desired product choices. It is always better to be safe than sorry. In the unlikely circumstance where items are out of stock you may request a national search. We are glad to help locate your items for you from alternate vendors however please be prepared for new pricing and shipping charges. All suppliers have their own pricing structure and cost of shipping varies by location. Once the shipment is picked up by the shipping company you will receive an email with the tracking and contact information for the shipping company. Please read this email carefully as it provides detailed instructions as to what to look for at the time of delivery. Basically, when the products arrive, please immediately check to ensure that there is no evidence of damage, wrong color or missing items. If you find any damaged materials put a note on Bill of Lading describing the damage and contact us immediately. If you sign the Bill of Lading and do not make notes regarding any problems with the shipment (such as damages, shortages, incorrect product, etc), is not responsible for refunds or replacements.


Samples are not returnable

All sold by are special order and thus are not subject to return or refund accept in the following circumstances: Items noted on the BOL document as damaged, missing or incorrect. Magic Floors Inc. will not refund or accept any returns on products due to color variation, incomplete orders, or where the Buyer simply changed their mind about the product altogether. By placing your order with, you are stating that you fully understand the Return Policy set forth by and that you accept these terms.


On the average your special orders are processed with within 1 hour of order placement. If you must cancel your order and the cancellation occurs before the order is processed, there are no consequences. Any credit card charges will be refunded and the order will be considered cancelled. In order to ensure timeliness, customer must cancel via phone and speak to Customer Service. Unfortunately processed orders cannot be cancelled.

PRODUCT SIZING carries a large assortment of Italian and Spanish tile. Tiles made in regions where the metric system is utilized will show nominal sizes only on our website! For example, a tile 30cm x 30cm will be listed as 12"x12" on This is a standard practice in the industry. Discount price applies to orders of 200 sq.ft. or larger only. Store price applies to the smaller orders. Very small orders will be examined on a case-by-case basis and will be priced based on Market conditions.

For the purposes of the below document Magic Floors Inc./ shell be referred to as the Seller and Magic Floors Inc./'s customer shell be referred to as the Buyer.

Conditions of payment: All orders must be paid in full prior to shipment to Buyer. In the case where the Buyer's credit card is denied or the Buyer's check bounces, Seller reserves the right to collect moneys owed in any way it seems appropriate including the use of legal means. All expenses related to collection attempts including but not limited to bounce check bank fees, credit card transaction charges, attorney and court fees, etc. will be the responsibility of the Buyer.

At we value your business large or small. As per our store policy the Discount Price applies to tile orders of 200 sq.ft. or larger only. Store Price applies to the smaller orders. Many of the products we offer are sourced from importers that have required order minimums which makes it difficult if not prohibitive to fulfill orders that are less than 200 sq.ft. As always, please do not hesitate to call Customer Service - orders that are close to the discount price cut off can sometimes be prorated to arrive at a price between the Discount and the Store price. Hardwood orders have a 400 sq.ft minimum order.

Prices and conditions of sale on all in-stock and special order merchandise are subject to change without notice. Every effort has been made to ensure the accuracy of all information contained herein. Seller makes no warranty expressed or implied with respect to accuracy of the information, including price, product editorials or product specifications. Product and manufacturer names are used for the purpose of identification only. All implied warranties including but not limited to implied warranties of merchantability and fitness for a particular purpose are hereby excluded. All products sold through the world wide web are final. Seller will not refund money or exchange any product purchased.

Disclaimer of Warranties on All products. Seller makes no warranties, either express or implied, with respect to all products and accompanying manuals and materials, regardless of their source, their quality, performance, merchantability or fitness for any particular purpose. All such items are sold or licensed to Buyer by Seller. On an "as is", "where is", and "with all faults" basis. The entire risk as to their quality and performance is with the Buyer. Should such product prove defective following their purchase, Buyer assumes the entire cost of all necessary servicing, repair, or correction and any incidental or consequential damages resulting from any defect in such product. In no event will Seller or its suppliers are liable for direct, indirect, incidental or consequential damages resulting from any defect, even if Seller has been advised of the possibility of such damages.

Seller, its products or its product suppliers, makes no warranty, express or implied, concerning the applicability of any product to any specific purpose. Seller, its product suppliers, accepts no liability for loss or damage caused, or alleged to be caused directly or indirectly by Buyer equipment or product sold by Seller,, including but not limited to any interruption of service, loss of business or anticipatory profits or special or consequential damages resulting from the use or operation of such products.

Condition of Sale: The terms and conditions of sale contained herein supersede all agreements made and purchase orders submitted to and accepted by Seller. All agreements are contingent upon such unavoidable incidents as strikes, accidents, material shortage, or other delays beyond Seller. Warranty: Items not accompanied by a warranty slip are guaranteed for 90 days from date of purchase. Warranty does not cover any damage due to accidents, misuse or negligence. All items factory warranted for longer periods of time must be sent for repair or replacement to the factory, or authorized service center with full insurance coverage and freight charges prepaid. (Refer to Warranty Slip for specific procedure.) Returns Policy: Returns can be accepted only on brand new factory-packed merchandise. Items returned in used or altered condition will not be accepted. Returns or exchanges accepted up to 3 days after arrival date (For Local Buyers only). All orders taken over the Internet are considered special orders and are not returnable. All returns are subject to a 35% restocking (35% applied to grand total) to cover processing, insurance and bank charges. If buyer needs to return an item (all returns [only for stock items] mast be filed in 3 business days starting from time of signing Bill of Lading. Returns sent by freight collect will be rejected.

Returns. All product sold by Seller on the are special order and thus are not subject to return or refund except under the following circumstances: Items noted on the BOL document as damaged, missing or incorrect. Seller will not refund or accept any returns on products due to color variation, partial orders, or where the Buyer simply changed their mind about the product altogether.

Cancellations. On the average your special orders are processed with within 1 hour of order entry. If you must cancel your order and the cancellation occurs before the order is processed, there are no consequences. If an order is cancelled prior to shipment and credit card proceeded, payment will be fully refunded minus a 5% bank credit charge and 20% processing fee.

Claims: All merchandise leaves our warehouse in good condition. The risk of loss or damage to goods shall pass to buyer as soon as such goods are picked up by carrier for delivery to buyer. Buyer should therefore inspect all packages for damages before signing delivery receipt. Claims should be filed immediately with the carrier (not with Seller) for merchandise damaged in transit.

Seller will make a good faith effort to complete delivery of the products as indicated by Seller in writing, nonetheless, Seller assumes no responsibility or liability and will accept no back-charge for loss or damage due to delay or inability to deliver, whether or not such loss or damage was made known to Seller. Seller shall have no liability for Seller's non-performance caused by acts of God, war, labor difficulties, accidents, inability to obtain materials, delays of carriers, contractors or suppliers or any other causes of any kind whatever beyond the control of Seller. Under no circumstances shall Seller be liable for any special or consequential damages or loss, damage, or expense (whether or not based upon negligence) arising directly or indirectly from delays or failure to give notice of delay. Buyer must be present to accept delivery. In the event that Buyer is unable to take delivery of the purchased item (at the originally agreed time and said Buyer fails to give Seller reasonable notice of such inability), seller reserves the right to charge Buyer any and all additional charges related to the second delivery.

At the time of purchase, the Buyer should know the brand name, the series, and the color of the product they request. Please note: pictures of tile on the website do not necessarily represent the actual color or size. The only way to be sure of the tile appearance is to view the actual tile prior to ordering. If a Buyer orders the wrong item, it is their responsibility. All Internet orders are considered special orders and cannot be returned.

Invoices are due and payable in accordance with the terms listed on the front of the invoice. An interest charge of 2% per month will be added to past due accounts. Transportation Charges for Warranty Service. The cost of freight or transportation to and from any of Sellers service locations required in order to complete any repair service under the terms of any manufacturer's limited warranty, will be at the expense of and charged to the Buyer. If a check tendered for payment by the Buyer is stopped or refused by the Buyer's bank, Seller will have the right to charge all or part of the amount due on any bank or charge card given by the Buyer as a credit guarantee.

Any part exchanged after the 1st day will be charged an expediting fee if the normal warranty procedures cannot be respected. Deposits are not refundable unless otherwise specifically stated. All Requests for Warranty Service or any other matters relating to the product must be accompanied with an invoice.

The amount of any sales, excise or other taxes, if any, applicable to the products shall be added to the purchase price and shall be paid by Buyer unless Buyer provides Seller with an exemption certificate acceptable to the taxing authorities. Any taxes which Seller may be required to pay or collect under any existing or future law, upon or with respect to the sale, purchase, delivery, storage, processing, use or consumption of any of the products, including taxes upon or measured by the receipts from the sale thereof, shall be for the account of the Buyer, who shall promptly pay the amount thereof to Seller upon demand. Buyer is subject to, and responsible for paying consumer use taxes in all states except Pennsylvania

All invoices and payments are subject to audit. All sales are contingent on the condition that the invoice will be audited and any mathematical will be corrected and will represent the true balance due. In the event of a dispute, Seller shall be entitled to recover reasonable attorney's fees and cost incurred in the dispute's resolution. For will call products, prices may be different than those on our website Item prices on Seller's invoices do not include product installation or support, unless expressly stated on the face of the invoice.

Severability. If any provision hereof is held to be illegal, invalid or un-enforceable under any present or future laws, such provision shall be fully severable and the terms and conditions herein shall be construed and enforced as if such illegal, invalid or unenforceable provision had never been made a part hereof. The remaining provisions herein shall remain in full force and effect and shall not be affected by such illegal, invalid or unenforceable provisions or by their severance wherefrom.

Set-Off And Non-Waiver.Buyer shall not be entitled to set-off any amounts due Buyer against any amount due Seller in connection with this transaction. Seller's failure to insist upon the strict performance of any term or condition herein shall not be deemed a waiver of any of Seller's rights or remedies hereunder, nor of its right to insist upon the strict performance of the same or any other term herein in the future. No waiver of any term or condition hereunder shall be valid unless in writing and signed by Seller's president.

This document constitutes the entire agreement between the parties and contains all the agreements and conditions of sale; no course of dealing or usage of the trade shall be applicable unless expressly incorporated herein. EXPRESSLY INCORPORATED INTO THESE TERMS AND CONDITIONS ARE SELLER'S POLICIES PERTAINING TO THE FOLLOWING: SHIPPING DETAILS, RETURN POLICY, ORDER POLICY, SALES TAX POLICY, and PRIVACY POLICY. All transactions shall be governed solely by the terms and conditions contained herein.


Since the majority of the cost of the samples includes handling, packaging and shipping, samples are not returnable under any circumstances.
